Guest Terms
Ordering from businesses that use PalomaCEO.ai. Effective date: October 14, 2026. Last updated: October 14, 2026.
These terms are between you and PalomaFinTech LLC, doing business as PalomaCEO.ai ("Paloma", "we", "us"), 2590 Hollywood Blvd, Hollywood, FL 33020, United States. They apply when you order from a restaurant or store (the "business") on an online ordering page that Paloma runs for that business — at order.palomaceo.ai or at the business's own web address — or when an AI assistant you use, such as ChatGPT, Claude or Gemini, orders for you through Paloma's ordering service. By placing an order this way, you accept them. Calls with a business's AI phone assistant and the texts we send are also described in our SMS Terms; how we handle your information is in our Privacy Policy. Businesses that use Paloma are bound by separate Terms of Service.
1. The business is the seller
Paloma is a software service that businesses use to take orders. When you order, you buy from the business, not from Paloma: the business is the seller and the merchant of record, and your purchase is a contract between you and the business. The business sets its menu, prices, taxes, fees, opening hours and what is available, and it prepares and hands over your order. Paloma is not a party to the sale, does not own or take title to what you buy, and gives no warranty about the food or goods. The business may have its own terms for what it sells, and they apply between you and the business.
2. Ordering through an AI assistant
- The assistant is yours, not ours. ChatGPT, Claude, Gemini and other AI assistants are run by their own providers under their own terms and privacy policies. Paloma does not run, control or see your conversation with them; the assistant sends Paloma only what it needs to order for you.
- What Paloma's ordering service does. It lets the assistant find businesses that allow ordering this way, read a business's menu with the prices and availability its point-of-sale system shows at that moment, price a delivery to your address with the delivery company the business uses, place a pickup or delivery order for you, and check how the order is going. Delivery is offered only where and when the business delivers and a courier is available; otherwise the order can be picked up.
- You confirm first. Our service tells the assistant to read back to you, before it places an order, the items, the total before tax, your name and your mobile number — for delivery also the address, the delivery fee, the courier tip and that the delivery company gets your name, number, address and instructions and may text or call you about the delivery — to tell you that texts about the order, such as the payment link or the confirmation, may be sent to that number, and to place the order only after your clear yes. We cannot see whether it did, so do not say yes to an order you have not checked, and give the assistant only your own mobile number or the number of someone who agreed to get the order's texts.
- AI can be wrong. An assistant can mishear, misread or misunderstand — an item, an option, a quantity, a name or a number. Check what you ordered and the total on the order's page and on the payment page before you pay. What the payment page shows is what you pay.
- Your information. For an order, the assistant gives Paloma your name, your mobile number, the items and any note, and, if you give it one, your email address for the receipt; for delivery, also your address, instructions for the courier and the tip you chose. The delivery company that takes a delivery gets what its driver needs, as our Privacy Policy describes. An assistant can never sign you up for a business's emails or offers. Paloma limits how many orders one number can place in a short time.
3. Paying
- Online. When the business takes payment online, you get a link to your order's page on Paloma's ordering site. Its Pay button opens the business's secure payment page, run by the business's payment provider — such as Clover, Square or Stripe. You pay there, and the money goes from that provider to the business, never through Paloma. The business starts your order once it is paid; an order not paid before its payment link expires is not prepared.
- At pickup. When the business takes payment at pickup, your order goes to the business as soon as it is placed, and you pay there. To change or cancel it, call the business at once.
- Never give your card to an assistant. Paloma never asks for card details in a chat, by text or on a call, and its ordering service has no place for them. Type them only on the payment provider's page.
- Paloma is not a payment processor, money transmitter or bank, and Paloma does not take payment from you.
4. Texts about your order
When you place an order — on an ordering page, on a call or through an AI assistant — you ask us to text the mobile number given for it about that order: the payment link, a confirmation, updates such as a courier on the way, a notice if the order could not be placed, and a refund notice. These are messages about your own order, never marketing. Each business decides which of these updates it sends. Message and data rates may apply. Reply STOP to any of our texts to stop them, or HELP for help. The full terms of our texts are in our SMS Terms.
5. Refunds, cancellations and problems with an order
The business handles everything about what you bought: changes, cancellations, refunds, missing or wrong items, quality, and pickup and delivery times. Contact the business directly — its phone number and address are on its ordering page and on your order's page. A refund is made by the business through its payment provider, under the business's own policy. Paloma cannot issue refunds on its own, but if you cannot reach the business, write to support@palomaceo.ai and we will pass your message to it.
6. Allergies, age-restricted items and safety
Menu descriptions, ingredients, allergen information and calories come from the business; Paloma does not check them and does not judge whether an item is safe for you. Paloma passes your allergy note or instruction to the business as given. If you have a food allergy, tell the business directly before you eat. For alcohol, tobacco and other age-restricted items, the business may ask for photo ID at pickup and may refuse to sell; the law of the business's state applies.
7. Using the service fairly
Use the ordering pages and the ordering service only to place real orders for yourself or for people who agreed to it. Do not place fake, prank or automated bulk orders, give someone else's number without their consent, try to get around limits, or interfere with or copy the service. Paloma or the business may refuse, limit or cancel an order or a number that breaks these terms. Do not use the service if you are under 13; if you are under 18, use it only with a parent's or guardian's permission.
8. Disclaimers
Paloma's ordering pages and ordering service are provided "as is" and "as available". To the fullest extent the law allows, Paloma disclaims every warranty not stated in these terms, including merchantability, fitness for a particular purpose and non-infringement. Paloma does not promise that the service, an AI assistant or any provider it relies on will be uninterrupted or error-free, that a menu, price or time shown is correct in every case, or that a business will accept, prepare or hand over an order. Nothing in these terms takes away a right you have against the business, or a consumer right that the law of the state you live in does not allow to be waived.
9. Limitation of liability
To the fullest extent the law allows, Paloma is not liable to you for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Paloma's total liability to you for all claims about the ordering pages and the ordering service is limited to US $100. These limits do not apply to liability that the law does not allow to be limited, such as for fraud, gross negligence, wilful misconduct, or personal injury caused by Paloma's own negligence.
10. Governing law and disputes
These terms are governed by the laws of the State of Florida and the federal law of the United States, without regard to conflict-of-laws rules, except where the law of the state you live in requires its own law to apply. Before starting a proceeding, please write to us at support@palomaceo.ai and give us 30 days to try to resolve it. A dispute that remains is resolved in the state courts in Broward County, Florida, or the United States District Court for the Southern District of Florida, unless the law of the state you live in lets you bring it in your own state; either of us may also bring an individual claim in a small claims court that has jurisdiction.
11. Changes and general terms
We may update these terms. We post the new version here with its date, and it applies to orders placed after it is posted. If a court holds part of these terms unenforceable, the rest stays in force. ChatGPT is a trademark of OpenAI; Claude is a trademark of Anthropic; Gemini is a trademark of Google LLC; Clover is a registered trademark of Clover Network, LLC; Square is a trademark of Block, Inc.; Stripe is a trademark of Stripe, Inc. Paloma is independent and is not affiliated with, endorsed by or sponsored by any of them.
